If you wish to create an Avera3d Account, you need to read, understand, and accept these Terms of Use for Customers.

The terms and conditions set forth herein ("Terms") constitute a legally binding agreement between Avera3d and you ("You" or "Your") regarding the terms on which Avera3d offers You access to its Website and Service. Your use of the Website or Service constitutes acceptance of these Terms.

I. Definitions

"Content" refers to any material published on Avera3d, including but not limited to models, images, videos.

"Buyer" refers to any person who creates a user account on Avera3d.com.

II. Rights Not Granted

Absent a written grant of rights greater than, all other rights or sub-divisions of rights generally included in copyright are excluded from this license and remain the property of the Seller.

III. License Agreement Between Seller and Member

By purchasing a 3D model or CAD file from Avera3d or any other website where models are presented, the buyer undertakes not to resell or distribute it for free to any third party on any website or social media and social media groups.

IV. Digital Modeling and Sculpting

All products presented on the website are digital files and not physical items.
V. Returned Content or Refund

Unfortunately, the refund policy in this area is complicated because the seller can never know for sure whether the buyer has removed the purchased model from their computer or not, or if they can restore it after removing it. Therefore, we inform you that Avera3d does not issue refunds. If you have any questions, please clarify with the seller before buying by contacting us via email or through the "contact us" section of the website.
VI. General Terms

Ownership: The seller retains ownership of the copyrights and all other rights in Seller Content, subject to the non-exclusive rights granted to us under this agreement. The seller is free to grant similar rights to others during and after the term of this agreement.
VII. Modification and Termination of Services; Amendment of Terms

Avera3d has the right to terminate your user account if it doesn't comply with the terms and conditions of the site or if it notices any disrespectful behavior by the user, actions that are against the site policy or damage to the site, such as offensive expressions, unjustified negative ratings, disruption of the normal flow of dialogue, or any other action that negatively affects other Site users' ability to use the Site. Site hacking, phishing, and any other action that will harm the site's normal work, mine, hack, spider, copy any proprietary information or ideas from the Site, transmit spam, bulk or unsolicited communications, or survey the Site.

Avera3d doesn't modify models because they are ready for 3D printing or CNC milling and should be used in jewelry casting.

Exclusive Use: The models provided are for your exclusive use in the production of physical products. You may use them for the purpose of creating physical jewelry or other custom products.

No Resale or Redistribution: The models are not for resale, redistribution, or sharing. You may not sell, distribute, or share the digital files or any variations of the models in any form, whether for profit or otherwise.

Modification: You may modify the models to suit your production needs, but the modified models are still subject to the same licensing terms.

Ownership: The intellectual property and ownership of the 3D models remain with the original creator. This license grants you the right to use the models for the creation of physical products, but not for resale or re-distribution of the digital files.

Prohibited Uses: You are prohibited from using the models for any purpose other than manufacturing physical products. You may not sell, distribute, or transfer the 3D printed resin, wax, or any other material created directly from the digital models. The digital files may not be shared, sold, or reproduced in any form for commercial purposes beyond the creation of physical products.

AI Training: The models may not be used to train artificial intelligence or machine learning systems. You may not upload, share, or use the models in any manner that contributes to the development or training of AI technologies.

Production Rights: You are permitted to produce and sell physical products created from the models, but the digital files may not be resold or transferred to others.

Because files are sent via the Internet, some delays may occur for which Avera3d is not responsible, as they are beyond our control.
